Rally operates an online service designed to provide a secure and scalable platform for our customers (“Customers”) to effectively research individuals (“Users”) (collectively, the “Services”).

In order to serve our Customers, we will collect various information directly from our Customers, including:
- Customer information including your name, title, company email, company name, phone number, company website URL.
- Correspondence, which may include any personal information provided during an email correspondence or Customer service engagement.
- Billing and administrative finance information.
- Metadata and analytics for your use of our Website and Services, including IP address, device information, date/time of visits, new or returning visits, products viewed, page response times, URL clickstreams, how long you stay on our pages, what you do on those pages.
- We may use cookies, beacons, pixel tags, and other similar technologies to collect additional information automatically as you interact with the Website and Services and to personalize your experience with our Website and Services. Learn more about our cookie use below.
- Inferences that may be drawn from or created based on any of the information identified above.
2. WHEN WE COLLECT INFORMATION
We may collect personal information that you provide when you:
- Directly from you when you interact with our Website and Services or otherwise contact us.
- Using online tracking technologies and other automatic data collection technologies, such as using pixels, web beacons, software developer kits, and cookies. Learn more about our cookie use below.

3. HOW WE USE PERSONAL INFORMATION
Subject to the terms of our Customer agreements, we may use personal information for the following business purposes:
- To provide our Website and Services.
- To communicate with you.
- To process payments securely.
- Customer support, including email, phone, and chat.
- To send transactional SMS notifications about session bookings, reminders, and schedule updates in accordance with your preferences.
- To improve our Website and Services, for example, we may modify our user interface based on Customer behavior.
- To send our Customers marketing and promotional communications in accordance with individual marketing preferences.
- To authenticate, verify or otherwise ensure compliance with Customer written instructions or to mitigate the risk of fraud, including through the use of SMS to verify your identity or device.
- Aggregated or anonymous information about the various types of information, integrations, metadata and performance metrics to ensure our Website and Services are serving their intended purposes and for product improvements.
- For any legal purpose necessary, including IP protection, or if we are required to process information as a result of a court order or other legal or regulatory proceeding.
4. HOW WE DISCLOSE PERSONAL INFORMATION
We utilize various service providers to operate our Website and Services, which includes sharing Customer personal information for the following categories of business purposes:
- With your consent, such as in providing our AI Features and functionality. This may include disclosure of your information with our artificial intelligence providers. The contents of the disclosure will not be used for any purpose other than to support us, and will not be used for training or improvement of the AI Features as per our AI Terms of Use.
- Helps us provide our chatbot, which may include disclosure of the communications with our service provider, Intercom, Inc. The contents of the communications will not be used for any purpose other than to support us, but are also subject to Intercom, Inc.’s applicable terms of service and privacy policy.
- Schedule panels and provide video conferencing capabilities.
- Cloud-based accounting software providers.
- Manage and optimize our Website and Services (see ‘Cookies and other Tracking Technologies’ below).
- Advertising or marketing service providers exclusively to benefit Rally UXR.
- Process payments.
In addition, we may share personal information in order to;
- Protect the legal rights of our Customers, our company, our employees, our agents, and our affiliates.
- Protect the safety and security of those who access and use our Website and Services.
- Detect and protect against fraud.
- In certain situations, we may be required to disclose personal information in response to lawful requests by public authorities, including to meet law enforcement requirements or a court order, subpoena, or other judicial, administrative, or investigative proceedings.
- We may disclose personal information as part of a business transition. For example, we may disclose personal information with prospective purchasers exclusively to evaluate the proposed transaction. You will be notified via email and/or a prominent notice on our Website of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.
We may disclose de-identified, aggregate, or anonymous information for any purpose. This means that the information we disclose does not identify specific individuals, nor is combined with other data to protect your privacy.
5. PRIVACY CHOICES
We provide you with the following choices with our use of your personal information:
- Access the personal information we maintain about you.
- Delete the personal information we maintain about you. Please note we may be required by law to retain certain information in compliance with accounting, tax or other legal obligations.
- Correct inaccurate personal information we maintain about you
- Opt out of certain uses of your personal information, notably:
- Marketing Emails: To opt out of marketing e-mail communications, you may click the ‘unsubscribe’ link in the marketing emails.
- SMS: Reply STOP to stop SMS messages. Reply HELP for help. You may also adjust notification preferences in your account. We do not sell or share mobile numbers or SMS consent information.
- Tailored advertising using cookies: Refer to our list of advertising services below for company-specific choices, or visit http://optout.aboutads.info to exercise an industry-wide opt-out. In addition, you may reject or delete cookies through your browser settings.
- Our use of your photos/videos, reviews, social media posts on our website or social media.

If you are a former User associated with one of our Customers, and you would like to fulfill your rights to the personal information we maintain about you on behalf of that Customer, we encourage you to exercise these rights by contacting that Customer. Alternatively, if you email us at privacy@rallyuxr.com and identify the Customer that is utilizing our Services, we can forward your request to the appropriate contact.
6. COOKIES AND OTHER TRACKING TECHNOLOGIES
Like many companies, we use cookies and similar technologies (such as clear gifs, web beacons, tags, and similar technologies) to collect information about your browsing activities, your interactions with websites and our Services, and to serve tailored ads and for the purposes described in this Privacy Policy. There are a number of ways to opt out of having your online activity and device data collected through these services, which we summarize below:
- Opting out of cookie use in our Cookie Preferences. You can opt out of cookies via our ‘Your Privacy Choices’ page. You may also opt out by broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (GPC) (on the browsers and/or browser extensions that support such a signal). If you choose to use the GPC signal, you will need to turn it on for each supported browser or browser extension you use.

- Blocking Cookies In Your Browser. Most browsers let you remove or reject cookies, including cookies used for interest-based advertising. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. - Advertising Industry Opt-Out Tools. You can also use these opt-out options to limit use of your information for interest-based advertising online or in apps by visiting http://optout.aboutads.info for U.S. residents, and https://www.youronlinechoices.eu/ for EU/UK residents..
- With Each of Our Vendors Individually. The following advertising or marketing services partners offer opt-out features that let you opt-out of use of your information for interest-based advertising or profiling:

Please note that because these opt-out mechanisms are specific to the device or browser on which they are exercised, you will need to opt out on every browser and device that you use.
7. SECURITY
We maintain reasonable safeguards to protect against unauthorized access, use, modification, and disclosure of personal information in our custody and control. Despite our efforts, we cannot guarantee that unauthorized access or use will never occur. It is important that you take steps to keep your information safe and secure. Choose an account password that is hard for others to guess and don’t reveal it to third parties. If you use a shared public computer, do not opt to have your login ID or password remembered and be sure to log out of your account when you finish.
8. RETENTION
We will retain Customer personal information only for as long as it is necessary for the purposes of fulfilling our Website and Services or otherwise as described in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). We retain SMS consent and opt-out logs only as long as necessary to provide the Services or comply with law. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.
9. U.S. STATE-SPECIFIC NOTICE
Some U.S. states have enacted comprehensive privacy laws. In addition to the rights granted in ‘Your Privacy Choices’ above, if you are a resident of the above states, you may have the right to:
- Access the specific pieces of personal information. For details about the categories of the personal information we have collected over the last twelve months, including the categories of sources, please see the ‘Personal Information We Collect’ section above. We collect this information for the business and commercial purposes described in the ‘How We Use Your Personal Information’ section above. We share this information with the categories of third parties described in the ‘How We Disclose Your Personal Information’ section above. If you would like to access the specific pieces of personal information we process about you, contact us at the email address below.
- Opt out of the ‘sale’ or ‘sharing’ of your personal information for targeted or cross-contextual behavioraladvertising. We do not ‘sell’ or ‘share’ your personal information including mobile numbers or SMS consent information for monetary benefit. However, some third party advertising pixel tags/cookies placed on our Website may be considered a ‘sale’ or ‘share’ under these privacy laws. You may opt out of such pixel tags/cookies as detailed in ‘Use Of Cookies and Tracking Technologies’ section (above).
Appeal:
If we deny your privacy request, you may appeal that decision by emailing us at privacy@rallyuxr.com. We will respond to your appeal within a reasonable period of time and as required by law. If, after we have processed your appeal, you are still unsatisfied with our response, you have the right to file a complaint with your state attorney general.
Authorized Agent:
If you are an authorized agent submitting a request on behalf of another person, you must provide a copy of a lawful power of attorney or written authorization from the consumer (along with proof of your identity). If you make a request as an authorized agent, you will receive additional instructions. Depending on the type of request, we may contact you or the consumer on whose behalf you claim to act to verify your authorization.
Controller/Business and Processor/Service Provider Designation:
We operate as a Controller (and a ‘Business’ under CCPA) with respect to information we collect directly from Customers to administer our Services.
10. UK/EEA RESIDENTS NOTICE
Residents of the (“UK”) and European Economic Area (“EEA”) are provided certain privacy rights under the UK and EU General Data Protection Regulations (“GDPR”).

Controller and Processor Designation:
Under the GDPR, we are designated as a Controller with respect to all Customer information. With respect to all User information, we operate as a Processor under the GDPR.
Cross-Border Data Transfers:
We may transfer to, and store the data we collect about you, in countries other than the country in which the data was originally collected, including the United States, Canada or other destinations outside the EEA and the UK. Those countries may not have equivalent data protection laws as the country in which you provided the data. When we transfer your data to other countries, we will protect the data as described in this Privacy Policy and applicable supplemental product privacy policy and comply with applicable legal requirements providing adequate protection for the transfer of data to countries outside the EEA or UK.
If you are located in the EEA or UK, we will only transfer your Personal Data if:
- The country to which the Personal Data will be transferred has been granted a European Commission adequacy decision; or
- We have put in place appropriate safeguards in respect of the transfer, for example we have entered into the Standard Contractual Clauses adopted by the European Commission and required additional safeguards with the recipient, or the recipient is a party to binding corporate rules approved by a supervisory authority.
Additional Rights for UK or EEA Residents:

11. CHILDREN’S PRIVACY
We do not intentionally collect any personal information from children under the age of 13 (or 16 in California). If you are under the age of 13 (or 16 in California), please ask a parent or guardian for help in using our website or utilizing our Services. If you believe we have obtained personal information associated with children under the age of 13 (or 16 in California), please contact us at privacy@rallyuxr.com and we will delete it.

The Services may contain links to other websites or services. We do not exercise control over the information you provide, or is collected by these third party websites. We encourage you to read the privacy policies or statements of the other websites you visit.

We may update this Privacy Policy from time to time as we update or expand our Website and Services. If we make material changes, we will post the updated Privacy Policy on this page with a ‘Last Updated’ effective date of the revisions. Services Privacy Policy
1. PERSONAL INFORMATION WE COLLECT
When our Customers use our Website and Services, they may enable us to process various types of personal information on their Users. Below, we provide a list of the commonly processed personal information of Users. Please note, the below list is not exhaustive of all personal information, and is intended to serve as a sample set.
- Contact information such as name, email address, phone number, mailing address, and other pseudonymous data.
- Age, gender and other demographic information, which may include information deemed ‘sensitive’ under global regulations (See below).
- The personal data provided when a User completes surveys, reviews, and responds to quizzes or otherwise provides us with comments or feedback.
- Information on business activities, including engagement rates, number of leads generated, which campaigns are functioning best, conversion rates, and trends.
- Audio, electronic, or visual information such as photographs and video recordings.
- Precise Geolocation data.
- Metadata and analytics for Users’ use of our Website and Services, including IP address, device information, date/time of visits, new or returning visits, products viewed, page response times, URL clickstreams, how long Users stay on our pages, what Users do on those pages.

- From our Customers when they use our Website and Services.
- From our business partners, notably market research providers who fulfill surveys or other research campaigns on behalf of our Customers.

- To provide our Website and Services, including managing market research panel participant contact and respondent information on behalf of our Customers.
- To improve our Website and Services, for example, we may modify our user interface based on User behavior.
- To send Users email communications on our Customers behalf in accordance with written instructions.
- To authenticate, verify or otherwise ensure compliance with Customer written instructions or to mitigate the risk of fraud, including through the use of SMS to verify your identity or device.

4. HOW WE DISCLOSE PERSONAL INFORMATION
Our Services provide Customers with the ability to synchronize certain external software or data applications with Rally, which may include the transfer of personal information. Some of the types of applications are:
- Market Research Providers
- Video Conferencing Providers.
- Scheduling.
- Email Service Providers.
- Incentive Distribution.
- Social Media.
Subject to our Customer agreements, we may disclose information to:
- With your consent, help us provide our AI Features and functionality. This may include disclosure of your information with our artificial intelligence provider. The contents of the disclosure will not be used for any purpose other than to support us, and the contents of the disclosure will not be used for training or improvement of the AI Features, but are also subject to the artificial intelligence provider’s applicable terms of use and privacy policy. - With our service providers under confidentiality agreements where they operate as a ‘subprocessor’ on our behalf.
In addition, we may share personal information in order to;
- Protect the legal rights of our Customers, our company, our employees, our agents, and our affiliates.
- Protect the safety and security of those who access and use our Website and Services.

We share mobile phone numbers and SMS consent information only with our SMS service provider(s) to deliver transactional messages and for compliance. No other use permitted.
No marketing sharing of SMS data.
The “Advertising or marketing service providers” category does not include mobile numbers or SMS consent information.
5. PRIVACY CHOICES
We enable our Customers to exercise privacy choices associated with their Users at any time through our Services. In addition, if we have sent you a commercial email or SMS on behalf of our Customers, you can follow the unsubscribe instructions in the email, or reply with the word ‘Stop’ to any SMS.
If you are an End User of our Customers, and you would like to fulfill your rights to the personal information we maintain about you on behalf of that Customer, we encourage you to exercise these rights by reviewing the Customer’s privacy policy to determine the correct contact method for that Customer. Alternatively, if you email us at privacy@rallyuxr.com and identify the Customer that is utilizing our Services, we can forward your request to the appropriate contact.
6. MOBILE COMMUNICATIONS & SMS SERVICES
We collect and use mobile phone numbers only to send transactional text messages related to your use of the Services, such as booking confirmations, reminders, schedule updates, and account or identity verification.
We do not send marketing or promotional text messages.
We do not sell, rent, or share mobile phone numbers or SMS opt-in information with third parties for marketing or promotional purposes.
We disclose mobile numbers and messaging metadata only to our contracted SMS service providers (for example, Twilio) to deliver the messages you request and to maintain required compliance records. Our service providers are required to protect your information and may not use it for any other purpose.
Opt-out anytime by replying STOP. For help, reply HELP. Message and data rates may apply. Message frequency is limited up to 6 times per interview booking. Carriers are not liable for delayed or undelivered messages.
We maintain timestamped consent and opt-out records for regulatory compliance and retain them only as long as necessary to provide the Services or meet legal obligations.
7. SECURITY
We maintain reasonable safeguards to protect against unauthorized access, use, modification, and disclosure of personal information in our custody and control. Despite our efforts, we cannot guarantee that unauthorized access or use will never occur. It is important that you take steps to keep your information safe and secure.
8. RETENTION

Additional Privacy Rights:
As noted above, we encourage any End users to exercise their privacy rights directly with our Customers, However, in addition to the rights granted in ‘Your Privacy Choices’ above, if you are a resident of the above states, you may have the right to contact our Customers with the following privacy requests:
- Opt out of Profiling.
- Access, opt out or delete sensitive personal information. Our Customers may enable Rally to process sensitive personal information as regulated by state privacy laws on their behalf, such as demographic information associated with market research.
Authorized Agent:
We do not accept Authorized Agent requests to exercise privacy choices associated with information shared by our Customers in conjunction with our Services.
Controller/Business and Processor/Service Provider Designation:
We operate as a ‘Processor’ (and a ‘Service Provider’ under the CCPA) with respect to all User information provided to us from Customers or in conjunction with our Services on behalf of any Customers.
10. UK/EEA RESIDENTS NOTICE
